1. Acceptance of Terms

  • By accessing or using this website, you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, please discontinue use immediately.

  • These Terms apply to all visitors, users, and others who access or use our website, services, or materials.

 

2. Purpose of the Website

  • The content on this website is for educational, informational, and wellness-related purposes only.

  • Nothing on this site should be interpreted as psychotherapy, medical advice, or a substitute for professional mental health or medical care.

  • While the founder of Grounded Wellness Collective is a Licensed Clinical Social Worker (LCSW), all coaching, yoga, and wellness offerings are provided outside the scope of psychotherapy and are intended for personal growth and wellness support only.

3. Eligibility

  • You must be at least 18 years old to access or use our services. By using this website, you represent that you are at least 18 years of age or have the consent of a parent or legal guardian.

4. Intellectual Property Rights

  • All content, materials, and graphics on this website: including text, images, logos, layouts, videos, and downloadable materials—are the property of Grounded Wellness Collective, LLC, unless otherwise stated.

  • You may not reproduce, distribute, modify, or republish any content without prior written consent.

  • Personal use of free resources (such as printable PDFs or worksheets that are indicated as "free") is allowed; redistribution or commercial use is prohibited without express permission.

When using our website or services, you agree not to:

  • Engage in unlawful, harmful, or fraudulent activity.

6. Coaching, Yoga, and Wellness Disclaimer

  • All coaching, yoga, and wellness services offered through Grounded Wellness Collective are non-clinical and not therapy.

  • They are designed for educational and personal development purposes.

  • You acknowledge that participation in these offerings is voluntary and that you are responsible for your own wellbeing and decisions.

  • If you are experiencing a mental health emergency within the U.S.A, please contact 911 or the 988 Suicide & Crisis Lifeline. For outside of U.S.A. individuals, please contact your local emergency or suicide & crisis hotline/lifeline.

7. Payments and Refunds

  • Payment for services, classes, or products must be made in full prior to participation unless otherwise arranged.

  • Refund policies will be clearly stated at the time of purchase (and within Refunds & Cancellations Policy section). All digital downloads and online materials are non-refundable once purchased.

8. Links to Other Websites

  • Our website may contain links to third-party websites for your convenience. We are not responsible for the content, accuracy, or privacy practices of those sites.

  • Use of external links is at your own risk.

9. Limitation of Liability

  • To the fullest extent permitted by law, Grounded Wellness Collective, LLC and its owner(s) shall not be liable for any damages or losses arising from your use of this website or services.

  • We make no guarantees about the results you may achieve through our coaching, yoga, or other offerings.

10. Limitations of Confidentiality

  • At Grounded Wellness Collective, your privacy and comfort are deeply valued. All information shared in 1:1 coaching sessions, group programs, or workshops is treated with care and respect. While confidentiality is an essential part of creating a safe and trusting space, it’s important to understand that coaching is not therapy and therefore does not carry the same legal confidentiality protections as clinical treatment.

  • Information shared with Grounded Wellness Collective will remain private and will not be disclosed without your written consent, except in the following circumstances:

    • There is reason to believe you may be in danger of harming yourself or someone else;

    • There is suspected abuse, neglect, or exploitation of a child, elder, or vulnerable adult, as required by Florida law;

    • Disclosure is required by a court order, subpoena, or other legal obligation;

    • Limited information is shared in professional consultation or supervision to ensure ethical and high-quality services, with all identifying details removed whenever possible.

  • Group and Workshop Confidentiality

    • In group coaching sessions or workshops, all participants are expected to maintain the privacy and trust of the group by keeping personal information shared by others confidential. However, Grounded Wellness Collective cannot guarantee that all participants will uphold confidentiality once they leave the group setting. By participating, you acknowledge and accept this limitation.

  • Public and Virtual Settings

    • If coaching sessions occur virtually, outdoors, or in a public setting, complete confidentiality cannot be guaranteed, as environmental factors may affect privacy. It is the client’s responsibility to choose a location that feels safe and private for them during sessions.

    • Grounded Wellness Collective maintains ethical standards of privacy and professionalism at all times and will make every effort to protect your confidentiality within the limits described above.

11. Indemnification

  • You agree to indemnify and hold harmless Grounded Wellness Collective, LLC, its owner(s), and affiliates from any claims, damages, or expenses arising out of your use of this website or services.

12. Legal and Court Involvement

  • Grounded Wellness Collective provides coaching, educational, and wellness services intended for personal growth, self-development, and overall well-being. These services are not intended for use in any legal proceedings or investigations of any kind.

  • Grounded Wellness Collective and its representatives will not provide evaluations, recommendations, or testimony for court cases, custody disputes, disability claims, or any other legal matters. Coaching notes are not designed or maintained for legal purposes and may not meet standards for legal documentation.

  • If Grounded Wellness Collective or its representatives are subpoenaed or required by law to participate in a legal matter involving a client, the client agrees to compensate for any related time and expenses at the following rates:

    • $250 per hour for time spent preparing, consulting, traveling, waiting, or attending any court or legal proceedings; and

    • Reimbursement for any reasonable travel expenses incurred in connection with the legal requirement.

  • This policy applies regardless of which party issues the subpoena or legal request. By engaging in services with Grounded Wellness Collective, you acknowledge and agree to these terms.

13. Defamation & Conduct

  • At Grounded Wellness Collective, we are committed to creating a safe, respectful, and supportive community. By using this website or participating in our services, you agree to maintain professionalism and refrain from any conduct that may cause harm to others or to our business.

  • You agree not to publish, post, or share any content, online or offline, that is false, misleading, defamatory, harassing, or otherwise injurious to Grounded Wellness Collective, its representatives, or its clients.

    • This includes but is not limited to:

      • Posting false or damaging statements on social media, review platforms, or public forums

      • Using language that harasses or discriminates against individuals associated with Grounded Wellness Collective

      • Misrepresenting your experience or our services

  • Grounded Wellness Collective reserves the right to remove access, terminate participation, and pursue appropriate action in the event of defamatory or harmful conduct.

  • We welcome honest feedback and invite clients to share concerns respectfully and directly through our official contact channels.

14. Right to Terminate Services & Commitment to Safety

  • At Grounded Wellness Collective, safety, trust, and emotional well-being are our highest priorities. We are committed to fostering a respectful, compassionate, and growth-oriented environment for all clients.

  • Grounded Wellness Collective reserves the right to terminate or decline services at any time if it is determined that:

    • The client’s needs would be better supported by another type of service (such as therapy or medical care),

    • The coaching relationship no longer feels appropriate, aligned, or mutually beneficial, or

    • The client engages in harmful, disrespectful, or disruptive behavior.

  • In such cases, the client may receive a partial or full refund for any unused sessions at the discretion of Grounded Wellness Collective.

  • If a referral to another professional is appropriate, we will make a good-faith effort to suggest supportive resources.

  • Our goal is always to ensure that every client feels safe, respected, and genuinely supported throughout the coaching journey.

15. Communication & Contact Permissions

  • By providing your email address and/or phone number, you consent to be contacted by Grounded Wellness Collective (“GWC”) regarding information related to the services, programs, or workshops you have registered for. This may include scheduling updates, reminders, confirmations, or service-related notices.

  • You also agree that GWC may send occasional promotional emails or text messages about upcoming offerings, workshops, events, or relevant updates. You may opt out of promotional communications at any time by using the unsubscribe link in emails or by replying “STOP” to text messages. Opting out of promotional messages does not affect GWC’s ability to contact you about services you have purchased or are currently participating in.

  • GWC will not sell, rent, or share your contact information with third parties.

16. Governing Law

  • These Terms are governed by and interpreted in accordance with the laws of the State of Florida, without regard to conflict of law principles.

  • Any disputes shall be handled in the appropriate courts of Pinellas County, Florida.

17. Changes to These Terms

  • We may update or modify these Terms at any time. Updates will be posted on this page with a revised “Effective Date.”

  • Your continued use of the website after changes are posted constitutes your acceptance of the updated Terms.
